Disclaimer, Terms of Use & Privacy Policy

Last updated: October 2026. This page sets out the basis on which you use this website, and how we handle personal information.

Disclaimer and limitation of liability

This website is a classified advertising marketplace. Advertisements are placed by users. We publish what advertisers provide, and we do not act as a real estate agent, auctioneer, broker, financial adviser, credit provider or valuer for any user.

We are not a party to any transaction

We do not sell, lease, inspect, value, manage or take possession of any property. Any enquiry, inspection, negotiation, agreement or payment for a property is strictly between the buyer or tenant and the advertiser. We take no commission, hold no deposit, bond, rent or trust money, and are not responsible for any dealing between users.

Content is provided as-is, without verification

We do not verify, and make no representation about, the accuracy, completeness, currency or legality of any advertisement — including ownership, title, price, rent, availability, floor or land area, inspection times, contact details or photographs. Listings may be amended, withdrawn or expire without notice. AI-assisted features (including generated descriptions, price estimates, market comparisons, suburb data and lender rate tables) produce general information only; they can be incomplete, inaccurate or out of date and are not financial, legal, valuation, taxation or investment advice. You should make your own enquiries and obtain independent professional advice before acting on anything you see here.

Scams, fraud and other users

We do not vet, screen or guarantee the identity, honesty or intentions of any user. Advertising attracts fraud, including fake landlords and sellers, payment redirection, phishing and fake "refund" or "verification" approaches. We never ask you for your password or card PIN, and we never ask you to pay by bank transfer, gift card or cryptocurrency outside the platform. To the maximum extent permitted by law, we are not liable for any loss, damage or cost caused by the fraudulent, dishonest, misleading or unlawful acts or omissions of any third party, including another user or a person pretending to be one. Report anything suspicious to us and to Scamwatch and your bank. Full details are in clause 12 of our Terms of use.

Technical issues, availability and information security

The website is provided on an "as is" and "as available" basis. We do not warrant that it will be uninterrupted, secure, timely or error-free, that defects will be corrected, or that content, emails, invoices or notifications will be delivered or stored without loss. Outages, maintenance, upload or payment failures, internet or device problems, third-party service failures, viruses and malicious attacks can interrupt or prevent access. To the maximum extent permitted by law, we are not liable for any loss, cost or damage arising from any technical failure, error, delay, interruption or unavailability of the website, from loss of or damage to data or uploaded files, or from unauthorised access to, or disclosure of, information held on or transmitted through the website. Full details are in clause 13 of our Terms of use.

All liability excluded

To the maximum extent permitted by law, we exclude all liability to you and to anyone else for any loss, damage, cost or expense of any kind (whether direct, indirect, incidental, special, consequential or punitive, and including loss of profits, savings, data, opportunity or reputation) arising out of or in connection with your use of, or inability to use, this website; reliance on any content or AI output; any advertisement or user; any transaction or communication between users; any third-party website we link to; or any interruption, delay, error, omission, virus or unauthorised access. You use this website entirely at your own risk.

Non-excludable rights

Nothing on this page excludes, restricts or modifies any guarantee, warranty, condition or right you may have under the Australian Consumer Law or any other law that cannot lawfully be excluded. Where such a right applies and our liability cannot be excluded, our liability is limited, at our option, to re-supplying the relevant service or to the amount you paid us for the advertisement in question (currently $10).

Your responsibility and indemnity

You are responsible for the accuracy and legality of anything you publish, for holding the rights to the photographs and video you upload, and for your own due diligence in any property dealing. You agree to indemnify us against any claim, loss or cost arising from an advertisement you publish or from your breach of these terms or of any law.

Terms of use

These Terms of Use ("Terms") govern your access to and use of the EstateLister website, mobile application and services (the "Platform"). The Platform is operated by RFNET PTY LTD (ABN 91 664 929 202) ("EstateLister", "we", "us" and "our"). By accessing the Platform, creating an account, posting an advertisement, sending an enquiry or paying a fee, you agree to be bound by these Terms, our Disclaimer and our Privacy Policy. If you do not agree, you must not use the Platform.

1. About these Terms

These Terms form a legally binding agreement between you and us. They apply to every visitor and user of the Platform, including private sellers, licensed agents and people searching for property. Where you use the Platform for a business or on behalf of an agency, you confirm you are authorised to accept these Terms for that business or agency.

In these Terms: "Advertisement" means a listing or other content you post; "Account" means your registered account; "Content" means text, photographs, video, data and other material; "Promoted Feature" means a paid bump-up, featured or highlighted placement; "Subscription" means a paid agent plan; and "Fee" means any amount payable to us.

We may change these Terms at any time by publishing the updated version on this page. Your continued use of the Platform after a change means you accept the updated Terms. We may also change, suspend or withdraw any part of the Platform, feature or fee at any time.

Nothing in these Terms excludes, restricts or modifies any right, guarantee or remedy you have under the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)) or any other law that cannot lawfully be excluded.

2. Eligibility and accounts

You must be at least 18 years old, have the legal capacity to enter into a binding agreement, and use the Platform only for lawful purposes in connection with property in Australia. You must provide accurate, current and complete information when you register, keep it up to date, and maintain one account for yourself (or one for your agency). Accounts and login credentials must not be shared, sold or transferred.

You are responsible for everything done through your Account and for keeping your login credentials secure. If you sign in through a third-party provider (such as Google, Facebook or Apple), your use of that provider is governed by its own terms, and you must keep that account secure. Tell us immediately if you believe your Account has been accessed without your authority.

We may refuse to register an Account, or suspend or close an Account, at our discretion — including where we reasonably believe these Terms, our listing rules or any law have been breached, or where the Account has been used fraudulently or to harm other users.

3. Your advertisements

You may advertise only property located in Australia that is genuinely offered for sale, for rent, or as part of a new development. You must have the authority to advertise it — as the owner, as a licensed real estate agent, or with the owner's permission — and you must be able to substantiate everything you state.

Licensed agents must hold a current licence in the relevant State or Territory and comply with all licensing, disclosure, auction, trust account and advertising requirements that apply to them, including rules about underquoting and price guides. We are not a licensed agent and do not supervise, verify or endorse any agent or agency.

Every Advertisement must be accurate, complete and up to date, and use only photographs and video you own or are licensed to use. One Advertisement per property. Prices, rents, outgoings, land and building areas, inclusions, availability and inspection times must not be false, misleading or deceptive in any way.

Advertisements must not, and you must not use the Platform to:

  • advertise a property that does not exist, is not available, or that you are not authorised to advertise;
  • duplicate an Advertisement, or post the same property repeatedly to gain prominence;
  • contain unlawful, defamatory, harassing, discriminatory or offensive material, or breach anti-discrimination, tenancy, planning or fair trading laws;
  • contain keyword spam, hidden text, unrelated links or content designed to manipulate search or rankings;
  • ask a buyer or tenant to pay any amount to you outside the Platform, or offer to pay us outside the Platform;
  • impersonate any person, agency or business, or misrepresent your affiliation with one;
  • collect or harvest other users' contact details, or use them for anything other than genuine property enquiries;
  • promote or facilitate any fraudulent, dishonest, unlawful or misleading scheme.

Every Advertisement is manually reviewed before it is published, and may be approved, refused or returned for changes. We may edit, refuse, pause, suspend or remove any Advertisement at any time, including after it has been published and paid for, if we reasonably believe it breaches these Terms, our listing rules or any law, or is otherwise harmful to the Platform or its users. We may also report unlawful or fraudulent content and the accounts behind it to police and regulators.

4. Enquiries and dealings between users

The Platform is a classified advertising marketplace only. We are not a real estate agent, auctioneer, buyer's agent, broker, property manager, valuer, financial adviser or credit provider, and we do not provide credit or financial product advice.

We do not verify the identity, authority, ownership, title, solvency or intentions of any user. We do not inspect property, hold deposits, bonds, rent or trust money, act as an escrow, or take any commission. We are not a party to any enquiry, inspection, negotiation, agreement, lease or transaction between users.

All dealings with other users are strictly between you and them, and are entirely at your own risk. Before acting, you should inspect the property in person, verify ownership and title, satisfy yourself about the person you are dealing with, and obtain your own legal, financial, taxation and valuation advice. If you are buying from overseas, you are responsible for complying with Australia's foreign investment rules (including FIRB approval).

5. Fees, subscriptions and payment

A flat Fee of $10 (AUD) applies to each Advertisement. The Fee is payable before the Advertisement goes live and is processed by our third-party payment provider. We do not store your card details. Once payment is confirmed, a tax invoice is emailed to you and your Advertisement is displayed for three months from the payment date, after which it is removed from display unless renewed or promoted.

Agent Subscriptions are charged in advance on a monthly or annual basis and renew automatically until cancelled. By subscribing you authorise us and our payment provider to charge the applicable Fee each period. You may cancel at any time and the Subscription will end at the conclusion of the period you have already paid for; no part-period refunds are given except where the law requires one.

Promoted Features are one-off purchases, priced per package as displayed at the time of purchase, and apply to the Advertisement and period stated in the package. Coupons and discounts are subject to their own conditions, are usually single-use, may be withdrawn at any time, and are not redeemable for cash.

All amounts are in Australian dollars and include GST where GST applies. Tax invoices are issued in the name of RFNET PTY LTD (ABN 91 664 929 202). If a payment is reversed, declined, charged back or disputed, we may suspend the Advertisement or Account and recover the amount from you, together with any associated costs.

6. Refunds — strict policy

All Fees are strictly non-refundable. Once the Fee has been paid and the Advertisement published, we do not provide refunds, credits, transfers or pro-rata amounts for any reason, including where you change your mind; the property sells, leases or is withdrawn early; you edit, pause or delete the Advertisement before the display period ends; the Advertisement is refused, removed or suspended because it breached these Terms, our listing rules or the law; a buyer or tenant does not proceed; or the Advertisement was posted in error or duplicated. Coupon codes and discounts are not refundable, exchangeable or redeemable for cash, and no refund or partial credit is given for an unused part of a display period, Subscription or Promoted Feature.

Nothing in this clause excludes or limits any refund, remedy or other right you have under the Australian Consumer Law or any other law that cannot lawfully be excluded, including where our service has failed to a major extent. Where such a right applies, we will provide the remedy the law requires, and any refund will be paid to the original payment method. To make a claim, contact us using the details in clause 22.

7. Promoted Features and ranking

Promoted Features move an Advertisement to a more prominent position, add distinctive styling, or rotate it through featured placements on the Platform for the period stated in the package. Promotion affects display and ranking only.

We do not guarantee any level of views, impressions, enquiries, inspections, offers, sales or rentals, and no refund is available because an Advertisement did not achieve a particular result. Promotions expire automatically at the end of their period, and we may change how Advertisements are ranked, displayed, rotated or grouped at any time.

8. AI features and information we provide

The Platform offers automated and AI-assisted features, including plain-English property search, drafted listing descriptions, price estimates and ranges, market snapshots, comparable sales and rental data, lender rate tables, suburb and school information, and property news. Some of this material is generated or compiled automatically and some is sourced from third parties.

All of it is general information only. It is not financial, credit, legal, taxation, valuation or investment advice, and it is not a valuation, appraisal or a substitute for advice from a licensed professional. AI output can be incomplete, inaccurate, out of date or based on assumptions that do not apply to your property or circumstances. You must not rely on it, and you should verify everything independently before making any decision. Lender rate tables are indicative only and are not an offer of credit.

9. Intellectual property and licence

We own, or are licensed to use, the Platform and everything in it that we create — including the EstateLister name and logo, the design, software, databases and compilations of listings and market data. You must not copy, reproduce, scrape, crawl, harvest, frame, mirror, resell or use any of it (including to train machine-learning models) without our prior written consent.

You keep ownership of the Content you upload. By posting Content, you grant us a worldwide, non-exclusive, royalty-free, transferable licence to host, store, reproduce, adapt, format, publish, display, distribute and promote that Content in connection with the Platform and its promotion — including making it available to search engines and allowing users to share links to your Advertisement through social networks and messaging apps. This licence continues while your Content is on the Platform and for a reasonable period afterwards for backups, caches and records we are required to keep.

You warrant that you own or are licensed to use all Content you upload, that it does not infringe anyone's intellectual property, privacy or other rights, and that you have obtained any consent needed from photographers, drone operators, occupants or other people appearing in it.

10. Third-party services and links

The Platform relies on and links to third-party services, including our hosting and application platform, payment processor, email delivery, mapping, analytics, social sharing and news and rate sources, and it contains links to third-party websites. Those services and sites are not under our control, and their own terms and privacy policies apply.

We do not endorse, verify or take responsibility for any third-party service, site, content, rate, article or data, and we are not liable for any loss arising from your use of them.

11. Acceptable use

You must not, and must not attempt to:

  • breach any law, including the Australian Consumer Law, the Privacy Act 1988 (Cth), the Spam Act 2003 (Cth), the Do Not Call Register Act 2006 (Cth), the Online Safety Act 2021 (Cth) and applicable State and Territory property and fair trading laws;
  • infringe anyone's intellectual property, privacy, confidentiality or other rights;
  • use personal information you obtain through the Platform for marketing, spam, harassment, doxxing or any purpose other than a genuine property enquiry;
  • introduce viruses, malware or harmful code, or interfere with, overload, probe, scan or attack the Platform or its security;
  • use bots, scrapers, automated tools or bulk processes to access, copy or republish Platform content;
  • create fake or duplicate accounts, or circumvent our review, approval, fee or promotion processes;
  • use the Platform to defraud anyone, launder money, or facilitate any dishonest or unlawful scheme.

12. Scams, fraud and dealing with others safely

We do not vet or screen users, and we cannot guarantee anyone's identity, authority or intentions. Property advertising attracts fraud, including fake landlords and sellers, fake buyers, payment redirection, phishing, overpayment and "refund" scams, and approaches that pretend to come from us.

We will never ask you for your password, a one-time code or your card details, and we will never ask you to pay a deposit, bond, rent or fee by bank transfer, gift card or cryptocurrency to an account outside the Platform. Treat any such request as a scam.

Do not send money to, or share identity documents or bank details with, anyone you have not met and independently verified. Inspect property in person, confirm ownership and title, use a licensed agent and a solicitor or conveyancer, and keep records of your dealings.

If you suspect a scam or fraudulent Advertisement, report it to us immediately, and also to Scamwatch (scamwatch.gov.au), your bank and the police (ReportCyber). We may investigate, remove content, suspend or close accounts, and report suspected fraud to the authorities.

To the maximum extent permitted by law, we are not liable for any loss, damage, cost or expense you suffer as a result of the fraudulent, dishonest, misleading or unlawful acts or omissions of any third party, including any user or person pretending to be a user, or of any scam or fraud carried out through or in connection with the Platform.

13. Technical issues, availability and data

The Platform is provided on an "as is" and "as available" basis. We do not warrant that it will be available at all times, uninterrupted, timely, secure or error-free, that defects will be corrected, or that Content, uploads, emails, invoices, notifications or messages will be delivered, stored or retained without loss or delay.

Access may be interrupted or prevented by scheduled or emergency maintenance, outages, internet, hosting, telecommunications, power, device, browser or app problems, failures of third-party services (including our application platform, payment processor, email, mapping and AI providers), software errors, viruses, denial-of-service or other attacks, data corruption, or events beyond our reasonable control. Features may also be changed, suspended or withdrawn at any time. You should keep your own copies of every photograph, video and description you upload.

To the maximum extent permitted by law, we are not liable for any loss, damage, cost or expense arising from any technical failure, error, omission, delay, interruption, unavailability, incompatibility or malfunction of the Platform or any third-party service, from any failure to publish, display, deliver or store an Advertisement or message, from loss of, damage to or corruption of data or uploaded files, or from unauthorised access to, use of, alteration of or disclosure of information held on or transmitted through the Platform.

14. Limitation of liability

To the maximum extent permitted by law, we exclude all liability to you and to anyone else for any loss, damage, cost or expense of any kind, whether direct, indirect, incidental, special, consequential, exemplary or punitive, and including loss of profits, revenue, savings, opportunity, goodwill, reputation or data, arising out of or in connection with the Platform, any Content or AI output, any Advertisement or user, any dealing between users, any third-party service or site, or any interruption, error, omission, virus or unauthorised access.

To the maximum extent permitted by law, our total aggregate liability to you for all claims relating to the Platform is limited to the greater of the total Fees you paid us in the 12 months before the event giving rise to the claim, and AUD $100.

Where a guarantee, warranty, condition or right under the Australian Consumer Law or another law cannot lawfully be excluded and our liability cannot be excluded, our liability is limited, at our option, to re-supplying the relevant service or paying the cost of having it re-supplied, or to the amount you paid us for the Advertisement in question (currently $10). Nothing in these Terms limits any liability that cannot lawfully be limited.

15. Indemnity

You indemnify us, our directors, officers, employees and contractors against any claim, loss, damage, liability, cost or expense (including reasonable legal costs) arising out of or in connection with your Content; your use of the Platform; your breach of these Terms or any law; your dealings with any other user; or any claim by a third party (including claims of intellectual property infringement, defamation, misleading or deceptive conduct, or breach of privacy) relating to anything you post or do on the Platform.

16. Privacy and personal information

We handle personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles, including the reforms that commenced in 2024 and 2025. Our Privacy Policy below explains what we collect, how we use and disclose it (including to service providers overseas), how we secure and retain it, the automated and AI-assisted decisions we make, and how to access, correct or complain about it. Our use of automated tools is also described there.

If you receive another person's personal information through the Platform, you must use it only for the genuine purpose it was given to you, comply with the Privacy Act 1988 (Cth), the Spam Act 2003 (Cth) and the Do Not Call Register Act 2006 (Cth), and not use it for marketing or share it with anyone else.

17. Suspension, termination and removal

We may suspend, restrict or terminate your access to the Platform, remove any Advertisement, and refuse to provide our services, at any time and without notice, where we reasonably believe these Terms, our listing rules or any law have been breached, where required by law or a regulator, or to protect the Platform, its users or us. You may close your Account at any time.

Fees already paid are non-refundable except as required by law (see clause 6). Clauses dealing with intellectual property, privacy, liability, indemnity, governing law and any other provision that by its nature should survive termination continue to apply.

18. Dispute resolution

If you have a complaint or dispute with us, contact us first using the details in clause 22 with enough detail for us to investigate. We will try to resolve it in good faith and will aim to respond within 10 business days.

Nothing in this clause prevents you from exercising any right or remedy you have under the Australian Consumer Law or any other law, or from contacting a regulator — including the ACCC or your State or Territory fair trading or consumer affairs body, or the Office of the Australian Information Commissioner for privacy matters.

19. Governing law and jurisdiction

These Terms are governed by the laws in force in the State or Territory in which our registered office is located, and by the laws of the Commonwealth of Australia. You and we submit to the non-exclusive jurisdiction of the courts of that State or Territory and the courts of Australia. Nothing in this clause affects any right you have under the consumer law of your own State or Territory.

20. General

If any provision of these Terms is unenforceable, it is severed and the rest continues to apply. A failure or delay by us in enforcing these Terms is not a waiver of our rights. We may assign or transfer our rights and obligations under these Terms; you may not do so without our written consent. These Terms, together with our Disclaimer and Privacy Policy, are the entire agreement between you and us about the Platform. Nothing in these Terms creates an agency, partnership or employment relationship. Headings are for convenience only. You consent to receiving notices and information electronically, including by email and through the Platform, as permitted by the Electronic Transactions Act 1999 (Cth).

21. Changes to these Terms

We may update these Terms from time to time. The date shown at the top of this page is the current version. Continued use of the Platform after an update means you accept the updated Terms.

Privacy policy

We handle personal information in accordance with the Privacy Act 1988 (Cth), the Australian Privacy Principles (APPs) and the reforms that commenced in 2024 and 2025. This policy explains what we collect, why, who we share it with, and the choices and rights you have. It applies to everyone who uses the website, whether or not you have an account.

Information we collect

Account details such as your name, email address, phone number and account type (private seller or agent); advertisement content you provide, including property details, photographs, video, inspection times and the contact name, phone number and email you choose to display; enquiries you send to an advertiser, including your name, email, phone and message; payment information, which is handled by our payment processor (we do not store card numbers); promotional and subscription records; and technical information such as IP address, device and browser type, and the pages you view.

We do not ask for sensitive information (such as health, racial or religious information) and you should not include it in an advertisement, photograph or message.

How we use it

To publish and display advertisements; to connect buyers and tenants with advertisers; to process advertising fees, promotion purchases and agent subscriptions and to email your tax invoice; to send service messages about your account, listings and renewals; to detect, investigate and prevent fraud, spam and misuse (including checking registrations against spam-blocking services); to comply with our legal, tax and record-keeping obligations; and to understand and improve how the website works.

Automated decision-making and AI

Some features are automated. We use computer programs, including AI models, to interpret plain-English property searches, draft listing descriptions, estimate prices, compile market and suburb comparisons, rank and rotate promoted advertisements, and screen registrations and listings for spam or misuse. These tools produce general information only and are not a valuation or advice — see clause 8 of our Terms of use. You can ask us for an explanation of a decision that materially affects you by contacting us using the details below.

What is public

Advertisement details, photographs, video and the contact details an advertiser adds are displayed publicly to anyone visiting the website, including search engines, and may be shared by users through social networks and messaging apps. Please do not include personal information you do not want to be public. Enquiries sent through an advertisement are visible to the advertiser they relate to.

Who we share it with

Our service providers who help us run the website — including our hosting and application platform, payment processor, email delivery provider, mapping and analytics providers — and any person or authority we are required or permitted by law to disclose it to, including police, regulators and courts. We do not sell personal information, and we do not disclose it to other users except as part of an advertisement or an enquiry you choose to send.

Disclosure overseas

Some of our service providers store or process information outside Australia, including in the United States and the European Union. Before disclosing personal information overseas we take reasonable steps to ensure it is handled consistently with the APPs, and we remain accountable for it under APP 8. By using the website you consent to these disclosures.

Direct marketing

We may send you service messages and, where permitted, information about the website and our paid features. We comply with the Spam Act 2003 (Cth) and the Do Not Call Register Act 2006 (Cth): every marketing message includes a way to unsubscribe, and you can opt out of marketing at any time without affecting service messages about your account, listings, payments or renewals.

Cookies and local storage

We use cookies and browser storage to keep you signed in, remember your preferences and measure usage of the website. You can clear or block these in your browser settings, although some features may then not work.

Retention

Advertisements are displayed for three months from the date the advertising fee is paid, after which they are removed from display. We keep records for as long as needed for the purposes above and to meet our legal, tax and accounting obligations (generally seven years for financial records), and then delete or de-identify them.

Security and data breaches

We take reasonable steps to protect personal information from misuse, interference, loss and unauthorised access, modification or disclosure, including access controls and encryption in transit. No method of transmission or storage is completely secure, so we cannot guarantee absolute security. If we become aware of an eligible data breach that is likely to result in serious harm, we will notify affected individuals and the Office of the Australian Information Commissioner as required by the Notifiable Data Breaches scheme.

Access, correction and deletion

You can review and edit your advertisements, and delete them, from your listings dashboard. To request access to, correction of, or deletion of other personal information we hold about you, contact us using the details below and we will respond within a reasonable time — generally within 30 days, or sooner where the APPs require it.

Children

The website is for people aged 18 and over. We do not knowingly collect personal information from anyone under 18. If you believe a child has provided us with personal information, contact us and we will delete it.

We will never ask for your password or card details

We will never contact you asking for your password, one-time code or card details, and we will never ask you to pay a deposit, bond or rent to a private bank account, gift card or cryptocurrency address. Treat any such request as a scam, do not respond to it, and report it to us and to Scamwatch.

Complaints

If you believe we have breached the Australian Privacy Principles, please contact us first so we can try to resolve it. If you are not satisfied, you may complain to the Office of the Australian Information Commissioner (oaic.gov.au).

Changes to this policy

We may update this policy from time to time. The date shown above is the current version, and continued use of the website after a change means you accept it.
